t.c.k.w inc. ("we" or "us") handles the personal information entrusted to us by our customers in operating the AMUAMI official online store (amuami.com) and Amuami-an in compliance with the Act on the Protection of Personal Information of Japan and other applicable laws.

2. Personal information we collect
We collect the following personal information.
(1) Name, address, telephone number and email address
(2) Order details, purchase history and delivery destination details
(3) Payment-related information. We do not retain credit card numbers; these are handled by our payment service provider.
(4) The content of enquiries and of reservations for Amuami-an
(5) The ID and password for the partner page
(6) IP address, browser and OS information, cookies and similar identifiers, browsing history on the Site, and records of operations on the Site (page views, scrolling, clicks and the like)
We collect the above when you enter information into a form on the Site, when you contact us by email or telephone, automatically by means of cookies and similar technologies, and by receiving information from our sales agents and other partners. Reservations for Amuami-an are received through a form provided by Google LLC.

3. Purposes of use
We use the personal information we collect for the following purposes.
(1) Selling products, settling payment, dispatching products and communicating with you in connection with these
(2) Responding to enquiries, managing the records of enquiries and providing after-sales service
(3) Receiving reservations for Amuami-an, providing information about your visit and attending to you on the day
(4) Distributing our newsletter and information about new products, exhibitions and other matters relating to the AMUAMI brand
(5) Authenticating and operating the partner page
(6) Analysing use of the Site and improving and developing our products, services and the Site (this includes providing personal data to the provider set out in section 8 of this policy for that purpose)
(7) Managing unpaid amounts and other receivables and payables
(8) Preventing fraudulent orders, unauthorised access and other improper use
(9) Responding to legal requirements and exercising and defending our rights
We do not use personal information beyond the scope necessary to achieve the purposes above.

4. Provision to third parties
We do not provide personal data to third parties without your prior consent, except in any of the following cases.
(1) Where required by law
(2) Where it is necessary to protect the life, body or property of a person and it is difficult to obtain your consent
(3) Where it is specially necessary to improve public health or promote the sound growth of children and it is difficult to obtain your consent
(4) Where it is necessary to cooperate with a national government body, a local government or a party entrusted by either of them in performing duties prescribed by law, and obtaining your consent is likely to impede the performance of those duties
The provision of personal data in connection with the entrustment described in section 5 and the joint use described in section 6 does not constitute provision to a third party under the law.

5. Entrustment of processing
Within the scope necessary to achieve the purposes of use, we may entrust the handling of personal data to the following types of service provider. In such cases we exercise necessary and appropriate supervision over them.
(1) Providers of the online store system
(2) Payment service providers
(3) Delivery service providers
(4) Providers of the form used to receive reservations and of access analysis services
(5) Providers of email delivery services
(6) Providers of the system used to authenticate and operate the partner page

6. Joint use
We jointly use personal data as follows.
Scope of joint users: us and Amuami inc. (Villa Bianca 503, 2-33-12 Jingumae, Shibuya-ku, Tokyo 150-0001, Japan)
Items of personal data jointly used: name, address, telephone number, email address, order and purchase details, records of reservations for and visits to Amuami-an, and the content of enquiries
Purposes of use by the joint users: the purposes set out in section 3(1) to (4) and (7) of this policy
Party responsible for management: t.c.k.w inc. (address and representative as set out in section 1 of this policy)

7. Handling of personal data in foreign countries
In connection with our use of the service providers set out in section 5 of this policy, we handle personal data in Singapore, Canada and the United States of America.
Where we ship products outside Japan, we also handle the delivery recipient's name, address and telephone number in the country or region of the delivery destination, through the international courier service provider and the delivery and customs clearance providers in the destination country. The countries and regions to which we can ship are set out in the Shopping Guide.
We have ascertained the personal information protection regimes of these countries and regions and take necessary and appropriate measures for the secure management of personal data. We have also concluded agreements on the handling of personal data with these service providers and take the measures necessary to ensure that they continuously implement measures for the protection of personal information (excluding Microsoft Corporation as described in the second paragraph of section 8 of this policy). If you contact the desk set out in section 11 of this policy, we will inform you of the names of the individual providers, the details of the measures we take and other particulars.

8. Use of cookies and access analysis
The Site uses cookies and similar technologies. Cookies are used to provide functions of the Site such as managing your shopping cart and maintaining your logged-in state, and also for analysing use of the Site through "Google Analytics", an access analysis service provided by Google LLC. We do not use information obtained through Google Analytics for the purpose of identifying a specific individual on its own.
The Site uses "Microsoft Clarity", provided by Microsoft Corporation, to record how the pages of the Site are displayed and where visitors stop reading, and uses this to improve the Site. Clarity records mouse movements, clicks, scrolling and other operations together with what is displayed on the screen, but does not record characters entered into input fields. Records of operations are deleted 30 days after they are obtained (records that we have labelled and saved are deleted after nine months). Information aggregated by page is deleted nine months after it is obtained.
These records are not handled by Microsoft Corporation on our behalf as an entrusted party. Microsoft Corporation handles the information it obtains at its own discretion, for the provision and improvement of its own services and for its other purposes. For that reason we activate Clarity only after obtaining your prior consent to the provision of this information to Microsoft Corporation. The country in which Microsoft Corporation is located is the United States of America. That country is not among the countries designated by rules of the Personal Information Protection Commission as having a personal information protection regime at a level equivalent to that of Japan. There is no cross-sectoral statute on the protection of personal information in that country; protection is provided sector by sector under federal and state law. The measures taken by Microsoft Corporation are as set out in its privacy statement (https://www.microsoft.com/privacy/privacystatement).
You can disable cookies in your browser settings. If you disable cookies, however, some functions of the Site may be unavailable. For visitors accessing the Site from the European Economic Area or the United Kingdom, we use cookies and similar technologies, other than those necessary for the functioning of the Site, only after obtaining your prior consent. 9. Measures for secure management
We take the following measures for the secure management of personal data.
Formulation of a basic policy: to ensure the proper handling of personal data, we have established this policy, which addresses compliance with applicable laws and guidelines and the desk for questions and complaints.
Methods of handling and person responsible: we have established methods for obtaining, using, storing and disposing of personal data, and the Representative Director, as the person responsible, checks how personal data is handled.
Human measures: we inform those involved in our business of the matters to be observed in handling personal data.
Physical measures: we take measures to prevent the theft or loss of equipment and documents that contain personal data.
Technical measures: we limit those who may use the information systems that handle personal data and have introduced mechanisms to protect against unauthorised external access.
Ascertaining the external environment: in handling personal data in the foreign countries and regions set out in section 7 of this policy, we have ascertained the personal information protection regimes of those countries and regions and take necessary and appropriate measures for secure management.

10. Requests for disclosure, correction, suspension of use and the like
You or your agent may request that we notify you of the purposes of use of retained personal data, disclose such data, disclose records of provision to third parties, correct, add to or delete the content of such data, or suspend the use of, erase or suspend the provision to third parties of such data.
Please make your request to the desk set out in section 11 of this policy by email or post. For a request for disclosure, you may specify either provision by electromagnetic record or delivery of a document. If you do not specify a method, we will respond by email. We will respond after confirming your identity. In order to confirm your identity we may ask you to submit a copy of an identification document. Where the request is made by an agent, please also submit a document evidencing the authority of the agent. We do not charge a fee.
Documents you submit will be disposed of by an appropriate method after our confirmation is complete.

12. Changes to this policy
We may change this policy. When we do, we will post the revised content on the Site. However, where we change the purposes of use of the joint users, or the party responsible for management, set out in section 6 of this policy, we will post the change on the Site in advance.

13. For residents of the European Economic Area and the United Kingdom
This section sets out the information we provide to residents of the European Economic Area (EEA) or the United Kingdom under the EU General Data Protection Regulation (GDPR) and the UK GDPR. Please read it together with sections 1 to 12.

(1) Controller
t.c.k.w inc. is the controller of your personal data. Our contact details are set out in section 11 of this policy. We have no establishment in the European Economic Area or the United Kingdom.

(2) Personal data processed
As set out in section 2 of this policy.

(3) Purposes of processing and legal bases
Selling products, settling payment, dispatching products, receiving reservations and responding to enquiries — performance of a contract or steps prior to entering into a contract (GDPR Article 6(1)(b))
Distributing our newsletter and similar communications — your consent (Article 6(1)(a)). Where you have already purchased our products, we may send information about similar products on the basis of our legitimate interests (Article 6(1)(f)).
Analysing use of the Site by means of cookies and similar technologies — your consent (Article 6(1)(a))
Improving our products and services and preventing improper use — our legitimate interests (Article 6(1)(f))
Complying with obligations under Japanese law, including the retention of books and records — our legitimate interests (Article 6(1)(f))

(4) Recipients of personal data
Within the scope necessary to achieve the purposes above, we provide personal data to the categories of entrusted service provider set out in section 5 of this policy and to the joint user set out in section 6. If you contact the desk set out in section 11, we will inform you of the names of the individual recipients.

(5) Transfers to third countries
We are located in Japan and your personal data is transferred to Japan. Japan is a country that the European Commission has recognised, by its adequacy decision of 23 January 2019 (Commission Implementing Decision (EU) 2019/419), as ensuring an adequate level of protection of personal data, and it is likewise recognised in the United Kingdom.
As set out in section 7 of this policy, personal data is also handled in countries and regions other than Japan through our service providers and, where we ship products outside Japan, through the providers involved in delivery. We handle such data in accordance with Article 28 of the Act on the Protection of Personal Information of Japan and the Supplementary Rules of the Personal Information Protection Commission on the handling of personal data transferred from the EEA or the United Kingdom on the basis of an adequacy decision. If you contact the desk set out in section 11 of this policy, we will inform you of how data is handled by each recipient and of the details of the measures we take.

(6) Retention periods
Information relating to orders and purchases — until the retention period for books and records under applicable law has elapsed
Records of reservations and enquiries — until they are no longer needed after the matter is concluded (we aim to delete them within three years)
Newsletter recipients — until you ask us to stop sending it
Information obtained through access analysis — 14 months from collection
Records of use of the Site — records of operations, 30 days from collection (nine months for records that we have labelled and saved); information aggregated by page, nine months from collection

(7) Your rights
You may exercise the rights of access, rectification, erasure, restriction of processing, objection to processing and data portability in relation to your personal data. Where processing is based on consent, you may withdraw your consent at any time (this does not affect the lawfulness of processing before withdrawal). You may also object at any time to processing for the purposes of direct marketing. To exercise these rights, please contact the desk set out in section 11 of this policy.

(8) Complaints to a supervisory authority
You have the right to lodge a complaint about our processing of your personal data with the supervisory authority of the Member State in which you reside (in the United Kingdom, the Information Commissioner's Office).

(9) Whether you are required to provide personal data
If you do not provide the information necessary to order products or to make a reservation or enquiry regarding Amuami-an, we are unable to accept your order, reservation or enquiry. The provision of any other information is optional.

(10) Automated decision-making
We do not take decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.
